STAR-BATT LIMITED WARRANTY

IMPORTANT: PLEASE READ THIS LIMITED WARRANTY CAREFULLY

This Limited Warranty contains important information about your rights and obligations. By using your Star-Batt product, you agree to the terms of this Limited Warranty.

1. DEFINITIONS

“Star-Batt” means Star-Batt, Inc., including its affiliates and authorized service providers.

“Product” means the Star-Batt portable battery system purchased by the original consumer purchaser, including Star-Batt Mini, Star-Batt Solar, and eligible accessories.

“You” or “Consumer” means the original end-user purchaser who purchased the Product new from Star-Batt or an authorized Star-Batt dealer.

2. WARRANTY CLASSIFICATION

This is a LIMITED WARRANTY as defined by the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301–2312 (the “MMWA”).

3. WARRANTY COVERAGE AND PERIOD

Coverage Period

Star-Batt warrants that the Product will be free from defects in materials and workmanship under normal and intended use for a period of twelve (12) months from the date of the original retail purchase by the original consumer purchaser (the “Warranty Period”).

NO PRODUCT REGISTRATION IS REQUIRED TO OBTAIN WARRANTY COVERAGE.

4. WHAT STAR-BATT WILL DO

During the Warranty Period, if Star-Batt determines that the Product contains a defect in materials or workmanship, Star-Batt will, at its option:

  1. Repair the Product using new or refurbished parts;
  2. Replace the Product with a new or refurbished product of equal or greater value; or
  3. Refund the original purchase price.

Repaired or replaced Products are warranted for the remainder of the original Warranty Period.

5. WHAT THIS LIMITED WARRANTY DOES NOT COVER

This Limited Warranty does not cover:

  • Normal wear and tear;
  • Damage caused by misuse, abuse, negligence, accidents, or improper operation;
  • Failure to follow user manuals, safety instructions, or technical specifications;
  • Unauthorized modification, repair, or disassembly;
  • External causes including fire, flood, lightning, or other acts of God;
  • Damage caused by use of incompatible chargers, accessories, or components;
  • Cosmetic damage that does not affect functionality;
  • Damage caused by shipping or handling after delivery.

Battery Limitations

Internal batteries are not covered for damage resulting from power surges, improper charging, water exposure, or normal capacity degradation over time.

Water and Dust Exposure

Products are rated IP65 only when all covers are fully closed and latched. This Limited Warranty does not cover damage caused by submersion, high-pressure water exposure, or environmental conditions exceeding the Product’s rated specifications.

6. SHIPPING AND PACKAGING FOR WARRANTY SERVICE

Dangerous Goods Shipping Requirements

Due to internal lithium batteries, certain Star-Batt Products are classified as dangerous goods for transportation purposes.

For warranty returns, Products must be shipped using packaging that complies with all applicable hazardous materials transportation regulations. Consumers may:

  • Use the original Star-Batt packaging; or
  • Use equivalent third-party packaging that meets all applicable regulatory requirements.

If compliant packaging is unavailable, Star-Batt may offer a certified replacement shipping kit for purchase. Failure to use compliant packaging may result in shipping delays or denial of warranty service.

7. HOW TO OBTAIN WARRANTY SERVICE

To initiate a warranty claim, contact Star-Batt Technical Support at support@star-batt.com and provide:

  • Proof of purchase;
  • Product serial number (if applicable);
  • A description of the issue.

Star-Batt will provide instructions for inspection, return, or repair.

8. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAR-BATT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF DATA, OR LOST PROFITS.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

9. STATE LAW RIGHTS

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

11. OPTIONAL ARBITRATION; CLASS ACTION WAIVER

Optional Arbitration.

At Star-Batt’s sole election, any dispute, claim, or controversy arising out of or relating to this Limited Warranty / Service Contract, the Product, or any services provided by Star-Batt (a “Dispute”) may be resolved by binding arbitration rather than in court, except where prohibited by applicable law.

If arbitration is elected by Star-Batt, the arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, as modified by this Agreement. The arbitration shall be conducted by a single neutral arbitrator and shall take place in Ada County, Idaho, unless the parties mutually agree otherwise.

Arbitration Costs.

Star-Batt will pay all filing, administrative, and arbitrator fees required by the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys’ fees and costs, unless otherwise required by applicable law.

Individual Proceedings Only; Class Action Waiver.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY. THE PARTIES EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING, WHETHER IN ARBITRATION OR IN COURT.

The arbitrator shall have no authority to consolidate claims, conduct class or representative proceedings, or award relief to anyone other than the individual party seeking relief.

Severability of Class Waiver.

If a court or arbitrator determines that the class action waiver is unenforceable with respect to a particular claim, that claim shall proceed in court rather than arbitration, and only that portion of this section shall be severed.

Consumer Rights Preserved.

Nothing in this section limits or waives any rights that cannot be waived under applicable state or federal law, including the Magnuson-Moss Warranty Act.

12. VENUE, JURISDICTION, AND STATE-SPECIFIC FALLBACK

Primary Venue and Jurisdiction.

To the fullest extent permitted by applicable law, any legal action or proceeding not subject to arbitration arising out of or relating to this Limited Warranty / Service Contract, the Product, or any services provided by Star-Batt shall be brought exclusively in the state courts located in Ada County, Idaho, or, if federal jurisdiction exists, in the United States District Court for the District of Idaho, Boise Division.

Each party irrevocably submits to the personal jurisdiction of such courts and waives any objection based on improper venue or forum non conveniens, except to the extent such waiver is prohibited by law.

State-Specific Fallback Venue.

If a court of competent jurisdiction determines that the exclusive venue provision above is unenforceable as applied to a particular consumer or claim, then venue shall lie in the state or federal courts located within the state of the consumer’s primary residence at the time the Product was purchased, and the parties consent to personal jurisdiction in such courts solely for that purpose.

Governing Law (Fallback Coordination).

In such event, Idaho law shall continue to govern the interpretation and enforcement of this Limited Warranty / Service Contract to the maximum extent permitted by law, without regard to conflict-of-laws principles.

Non-Waivable Rights.

Nothing in this section shall be construed to waive any consumer protections or remedies that cannot be waived under applicable state or federal law.
